Terms of Service

1. Agreement and Parties

These Terms of Service (“Terms”) constitute a binding agreement between you (“User”) and Aleph Technologies (Pty) Ltd (Registration No. [INSERT REGISTRATION NUMBER]), operator of the Aleph Safe platform at alephsafe.co.za and my.alephsafe.co.za.

If you accept these Terms on behalf of an organisation, you represent that you have authority to bind that organisation.

2. Description of Service

Aleph Safe is a web-based SaaS platform that uses artificial intelligence to assist users in generating occupational health and safety compliance documentation, including Risk Assessments, Method Statements, and Safe Work Procedures, in accordance with the Occupational Health and Safety Act 85 of 1993 and the Mine Health and Safety Act 29 of 1996.

3. Account Registration

To access Aleph Safe you must register with accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@alephsafe.co.za if you suspect unauthorised access.

4. Subscription Plans and Payment

4.1 Subscription Tiers

Aleph Safe is offered on a tiered subscription basis. Current pricing and features are published on our pricing page and may be updated from time to time.

4.2 Billing

Paid subscriptions are billed in advance, monthly or annually. All prices are in South African Rand (ZAR) and are inclusive of VAT where applicable.

4.3 Payment

Payment is processed by a third-party payment provider. By providing your payment details you authorise recurring charges until you cancel. We do not store full card details.

4.4 Failed Payments

If a payment fails, we will notify you and retry. If payment is not received within seven days of the due date, your account may be downgraded or suspended until payment is received.

4.5 Price Changes

We will provide at least 30 days’ notice of any price increase by email. Continued use after the effective date constitutes acceptance of the new price.

5. Free Tier

We offer a free tier providing limited access, currently up to five document generations per calendar month. The free tier is provided as-is and we reserve the right to modify or discontinue it with reasonable notice.

6. Cancellation and Refunds

6.1 Cancellation

You may cancel your subscription at any time from within your account settings. Cancellation takes effect at the end of the current billing period, after which your account reverts to the Free tier.

6.2 Money-Back Guarantee

If your first AI-generated document is not audit-ready, you may request a refund of your first month’s subscription fee within 14 days of your initial purchase by emailing support@alephsafe.co.za with details of the document and the specific compliance deficiency.

6.3 No Other Refunds

Except as stated in clause 6.2, subscription fees are non-refundable. We do not issue pro-rated refunds for partial months or unused document allocations.

7. Acceptable Use

You must not:

• Use the platform to generate documentation intended to deceive or mislead any person, authority, or inspection body.
• Attempt to reverse-engineer or extract the underlying AI model, training data, or proprietary systems.
• Use automated scripts or bots to access the platform.
• Resell or sublicense access to the platform without our prior written consent.
• Attempt to gain unauthorised access to any part of the platform or its servers.

8. Intellectual Property

8.1 Our Intellectual Property

Aleph Safe, including its AI models, software, design, and branding, is the exclusive property of Aleph Technologies (Pty) Ltd. Nothing in these Terms grants you any ownership interest in the platform.

8.2 Your Content

You retain ownership of your inputs and generated documents. You grant ALEPH TECHNOLOGIES a limited licence to process your inputs solely to provide the service. Your data is not used to train external AI models.

9. Disclaimer of Warranties

Aleph Safe is provided on an “as is” and “as available” basis. We do not warrant that the platform will be uninterrupted or error-free, or that any generated document will be accepted by any specific inspection body or authority. Generated documents must be reviewed by a competent person before reliance.

10. Limitation of Liability

To the fullest extent permitted by South African law, ALEPH TECHNOLOGIES shall not be liable for any indirect, incidental, or consequential damages, including loss of profit, regulatory penalties, or harm arising from reliance on a generated document without independent professional review.

Our total aggregate liability for all claims shall not exceed the total amount paid by you in the three months preceding the event giving rise to the claim. Nothing in these Terms limits liability for fraud or death or personal injury caused by our negligence.

11. Indemnity

You agree to indemnify and hold harmless ALEPH TECHNOLOGIES from any claims, damages, and expenses arising from your use of Aleph Safe, your violation of these Terms, or any claim by a third party arising from your use of a generated document.

12. Termination

We may suspend or terminate your account immediately if you breach these Terms, if we are required to do so by law, or if continued access poses a risk to other users. Upon termination your data is retained for 30 days, after which it may be permanently deleted. You may request an export before that period expires.

13. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any dispute shall be subject to the exclusive jurisdiction of South African courts. Both parties agree to first attempt resolution through good faith negotiation or, failing that, mediation under AFSA rules.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
